Estate planning is not just about your death. Estate planning involves much more than just deciding who will receive your assets at your death. Proper estate planning involves the design and implementation of a strategy to protect your family in the event of incapacity or disability as well as death.
- Planning for Incapacity
- Planning for Death
- Providing for Minor Children
One of the greatest concerns of seniors and their families is the cost of long term care, especially the cost of nursing home care. Long term care refers to a range of services necessary to meet your personal needs. Most long term care is not medical care, but assistance with the basic personal tasks of everyday life or activities of daily living (ADL’s). This type of assistance is generally referred to as Custodial Care.

Probate is the legal process by which assets titled in a decedent’s name are transferred to his or her heirs or beneficiaries. The entire process is supervised by the probate court of the county in which the decedent resided. If the decedent prepared a Will, the probate court will ensure that the directions contained in the Will are properly carried out. If the decedent had no Will or estate planning documents, the probate court will supervise the distribution of the decedent’s property to the persons designated to receive them by Ohio law.
- The admission of the Will to probate
- The notification of all heirs
- The inventory and valuation of the decedent’s assets
- The presentation and payment of claims against the estate
Veterans 65 and older or their surviving spouses may qualify for an Aid and Attendance Pension that can help pay long term care expenses. A qualifying married veteran may receive up to $2,169 per month. This monthly benefit can provide significant assistance to veterans who are in need of long term care.

My wife and I highly recommend Joe for estate planning services. We have been using Joe’s services for many years, and he has been extremely thorough and thoughtful. He created a comprehensive, efficient estate plan for our family, guiding us through each step in the process. He has also advised us on other legal matters and given referrals when needed.
We met Joe Motta at our church and interacted with him, through church, for years. We found him to be a man of integrity and honesty. It came time to revise our wills. We did not hesitate to employ the services of Joe. We first provided him the information he requested via a questionnaire. Our first meeting was professional he anticipated our concerns and provided the much needed information. Even to the point the questions we prepared, were answered, because he was through in his presentation. He provided us additional resources or information outside of the services he provides. He understood our needs, is someone we can have faith in as our trusted legal advisor and estate planner.

I have referred a number of clients to Joe for estate planning, probate and Medicaid planning needs. They all have enjoyed working with him. He is knowledgeable, has a friendly manner and he is easy to work with.
We have just completed the entire estate planning process with Joe. This is something I should have a done years ago but very glad it is done and also very happy we worked with Joe Motta. He is thorough, knowledgeable and really covered all the bases for us. I leaned an awful lot through this and it is so nice to know we control this and not a judge when the time comes. We highly recommend all get this done and also highly recommend Joe. You will not be disappointed.
Estate planning is something we have put off for years. Joe had provided seminars that I have attended in years past. When the decision was finally made to proceed the rare benefit of procrastinating paid off as his office is now in our town of residence. Joe proved quite knowledgeable and very easy to work with. He understood quickly what we were trying to accomplish. He produced the documents and arranged for the transfer of our home to a trust. He gave us explicit instructions on what else we had to do to accomplish the goal of setting up a trust for ourselves and children. He also assured us that he would be there for any snags of which there were none. A wholehearted endorsement.

My wife and I are extremely pleased with the service and personalized service you provided. I, personally, was pleased with your patience and the complete explanations we received from you. The product you provided was even more comprehensive than we anticipated and the addition of digital media to the paper media is most appreciated.
Thank you so much.

Joe was recommended to me by my financial advisor. This was an excellent recommendation as Joe expertly crafted our family’s Trust and papers to manage our life events. He is professional, friendly, and a pleasure to work with. He continues to be our trusted legal advisor and I would highly recommend him for any estate planning matter.
I have known Joe for years and when I needed help with my fathers estate I was so pleased to find out he was in the area by my home. He is truly someone you can trust which made the experience so much better. Joe is very knowledgeable and kind. I would highly recommend him.
Joe is so easy to work with. I would highly recommend Mr. Motta for any estate planning. The binder that was provided was so “updated”. It includes an entire section for outlining all online usernames/passwords for email, bank accounts, online shopping accounts, video game sites, cloud storage sites, and on and on. His recommendation to include printed beneficiary statements was also a great reminder. The flash drive provided is also great to have. Joe even provided the IRA distribution chart for younger family members to be aware of if/when the time comes. Everything, and I mean everything, is now in one place. Thanks to Joe and his staff.
